3. Resolve up front any legal issue that would jeopardize a sale

Here’s an example that I see fairly often in Anne Arundel and Calvert County: a shared driveway with no recorded driveway maintenance agreement. This will kill the sale for about 8 out of 10 buyers who are considering your property. The buyer will be nervous about getting an agreement worked out later and about the cost of possibly maintaining the driveway alone, if that doesn’t happen. They will also be concerned about the affect on a future sale if they were to buy the property. Even more importantly, it could affect the buyer’s ability to obtain financing. All perfectly legitimate concerns.

No matter the issue: boundary dispute, encroachment, easement problem, driveway maintenance agreement – get it handled first, then put the property on the market.
